1. Agreement to Terms

By accessing or using Fusion Cloud ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Fusion Cloud is a cloud-based platform for managing ADP (Assistive Devices Program) claims. The Service includes features for creating claims, managing devices, calculating portions, exporting data, team collaboration, and reports.

3. User Accounts

3.1 Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration.

3.2 Account Security

You are responsible for safeguarding your password and any activities under your account. You must notify us immediately of any unauthorized access to your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion.

4. Subscription and Payments

4.1 Subscription Plans

Access to certain features requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis.

4.2 Free Trial

We offer a 7-day free trial for new users. No credit card is required for the trial period. After the trial ends, you must subscribe to continue using paid features.

4.3 Refunds

Subscription fees are non-refundable except as required by law. You may cancel your subscription at any time, and it will remain active until the end of the billing period.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Submit false, misleading, or fraudulent claims
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the Service
Transmit viruses, malware, or other malicious code
Scrape, harvest, or collect user data without permission
Resell or redistribute the Service without authorization
Violate any applicable laws or regulations

6. Intellectual Property

The Service and its original content, features, and functionality are owned by FusionSoft and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any data you submit to the Service. By submitting data, you grant us a license to use, store, and process that data to provide the Service.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy. For Fusion Pro desktop software, additional terms apply as outlined in our Fair Use Policy.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability or fitness for a particular purpose
Warranties that the Service will be uninterrupted or error-free
Warranties regarding the accuracy or reliability of any information

9. Limitation of Liability

IN NO EVENT SHALL FUSIONSOFT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICE.

10. Indemnification

You agree to defend, indemnify, and hold harmless FusionSoft and its officers, directors, employees, and agents from any claims, damages, obligations, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Continued use of the Service after changes become effective constitutes acceptance of the new Terms.
